{"id":3383,"date":"2019-06-29T13:18:51","date_gmt":"2019-06-29T11:18:51","guid":{"rendered":"https:\/\/hrsly.com\/?p=3383"},"modified":"2020-05-30T15:03:37","modified_gmt":"2020-05-30T13:03:37","slug":"abu-salim-prison-massacre-23-years-passed-since-the-mass-killings-of-1161-detainees-and-justice-is-still-elusive","status":"publish","type":"post","link":"https:\/\/hrsly.com\/en\/abu-salim-prison-massacre-23-years-passed-since-the-mass-killings-of-1161-detainees-and-justice-is-still-elusive\/","title":{"rendered":"Abu Salim Prison Massacre 23 Years Passed since the Mass Killings of 1\u2019161 Detainees and Justice is still elusive"},"content":{"rendered":"<p>It has been almost 8 years since the collapse of the Gaddafi regime, which committed the massacre of Abu Salim Prison in Tripoli, the unprovoked<a href=\"#_edn1\" name=\"_ednref1\">[i]<\/a> mass killing of approx. 1\u2019200 unarmed detainees<a href=\"#_edn2\" name=\"_ednref2\">[ii]<\/a> on Saturday morning, 29<sup>th<\/sup> June 1996, and it has been five years since the General National Congress passed Law<a href=\"#_edn3\" name=\"_ednref3\">[iii]<\/a> (31\/2013) which committed<a href=\"#_edn4\" name=\"_ednref4\">[iv]<\/a> the State of Libya to \u201ccarry out a comprehensive and transparent investigation to determine the perpetrators and their accomplices and bring them to trial\u201d, however till today, 29<sup>th<\/sup> June 2018 which marks the twenty-second anniversary of the massacre, results of the investigation were not published, nor were defendants brought to trial.<\/p>\n<p>Human Rights Solidarity (HRS) wrote<a href=\"#_edn5\" name=\"_ednref5\">[v]<\/a> to the Office of the General Attorney to determine the fate of the prisoners who were being held the prison of \u201cReform and Rehabilitation Foundation \u2013 al-Hadhba\u201d, after an armed militia known as the \u201cTripoli Revolutionaries Battalion\u201d attacked the prison on 26<sup>th<\/sup> May 2017 and took an unknown number of prisoners to an undisclosed location<a href=\"#_edn6\" name=\"_ednref6\">[vi]<\/a>. More than 100 prisoners in al-Hadhba prison were defendants in the case of Abu Salim prison massacre<a href=\"#_edn7\" name=\"_ednref7\">[vii]<\/a>.<\/p>\n<p>To date, HRS has not received a reply from the Office of the General Attorney. To date, no information has been provided as to whether the prisoners were placed in an official prison run by the Judicial Police, of the Ministry of Justice, or in one of the detention centers run by armed groups outside the jurisdiction of the State.<\/p>\n<p>To date, the fate of the bodies of the victims is not known and therefore they are considered victims of enforced disappearance<a href=\"#_edn8\" name=\"_ednref8\">[viii]<\/a>. The crime of enforced disappearance does not stop at direct victims, but extends to the families of the victims.<\/p>\n<p>In light of the failure of the authorities to bring the accused to trial, and in light of the political polarization &amp; deadlock currently prevailing in Libya, it is clear that justice before the National Judiciary in this case; disclosure of what happened on the 29<sup>th<\/sup> June 1996, holding perpetrators accountable, and reparations for the victims and their families, is not possible in the foreseeable future. HRS has started exploring procedures to prosecute the accused in the case outside Libya, under the Principle of Universal jurisdiction, which permits the prosecution of those responsible for war crimes and crimes against humanity, regardless where the crimes were committed.<\/p>\n<p><a href=\"#_ednref1\" name=\"_edn1\">[i]<\/a> Human Rights Solidarity: \u201c<a href=\"https:\/\/www.facebook.com\/AbuSalimPrisonMassacre\/posts\/1718908354811128\">Abu Salim Massacre<\/a>\u201d, 29<sup>th<\/sup> June 2018, a copy of the report is attached \u201cLHRS PRS-2019-06-137 EN Annex 01.pdf\u201d.<\/p>\n<p><a href=\"#_ednref2\" name=\"_edn2\">[ii]<\/a> On the, 29<sup>th<\/sup> June 2016, Human Rights Solidarity, published <a href=\"https:\/\/www.facebook.com\/AbuSalimPrisonMassacre\/posts\/1418164054885561\">lists of the names of victims of the massacre<\/a> from the archives of the Internal Security Agency. The lists contained 1\u2019158 names. After the publication, several families contacted the organization informing it that their relatives, who perished in the massacre, were not included in the published lists. HRS verified the names of 3 victims from one family, el-Sharrani, hence the known number of victims is 1\u2019161 victims. See attachment \u201cLHRS PRS-2019-06-137 EN Annex 02.pdf\u201d for the lists.<\/p>\n<p><a href=\"#_ednref3\" name=\"_edn3\">[iii]<\/a> General National Congress: Law (31)\/2013 \u201cOn setting some of the Special Provisions for the Massacre of Abu Salim Prison\u201d, 18<sup>th<\/sup> December 2013, <a href=\"http:\/\/www.log.gov.ly\/downloads\/add04-2014.pdf\">Libyan Official Gazette, 3<sup>rd<\/sup> Year, issue no.
