It is absolutely prohibited under all relevant instruments and cannot be justified under any circumstances. This prohibition is part of customary international law, binding on all states regardless of treaty ratification. When torture is practiced systematically or on a widespread scale, it constitutes a&nbsp;<strong>crime against humanity<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Torture aims to destroy the victim\u2019s personality and negate the inherent dignity of the human being. The United Nations has condemned torture from its earliest days as one of the vilest acts committed by human beings against one another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 12 December 1997, through Resolution 52\/149, the UN General Assembly proclaimed&nbsp;<strong>26 June<\/strong>&nbsp;as the International Day in Support of Victims of Torture, reaffirming the goal of the total eradication of torture and the effective implementation of the Convention Against Torture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Libya is a State Party to the Convention. It has domestic legislation criminalizing torture. Yet, because of the proliferation of weapons, the dominance of armed groups, political fragmentation, and, above all,&nbsp;<strong>near\u2011total impunity<\/strong>, torture remains widespread in Libya\u2019s prisons and detention centers run by official bodies, parallel institutions, militias aligned with the Government of National Unity, militias aligned with the House of Representatives and Khalifa Haftar, and human\u2011trafficking networks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2026: A Year Marked by Judicial Collapse and Protection of Perpetrators<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>The Acquittal of Abdullah al\u2011Senussi and 30 Former Regime Officials<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">On&nbsp;<strong>18 May 2026<\/strong>, the Tripoli Court of Appeal (Thirteenth Criminal Circuit) acquitted former intelligence chief&nbsp;<strong>Abdullah al\u2011Senussi<\/strong>&nbsp;and 30 other senior officials of the Gaddafi regime in Case No. 630\/2012, related to the violent suppression of demonstrators during the February 17, 2011-revolution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This ruling came&nbsp;<strong>despite overwhelming evidence<\/strong>, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>video recordings of torture,<\/li>\n\n\n\n<li>mass graves,<\/li>\n\n\n\n<li>hundreds of witness statements,<\/li>\n\n\n\n<li>and official documents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Al\u2011Senussi is&nbsp;<strong>indicted by the International Criminal Court (ICC)<\/strong>&nbsp;for war crimes and crimes against humanity. Libya insisted on trying him domestically, and the ICC deferred to Libya\u2019s request. The outcome is a&nbsp;<strong>complete miscarriage of justice<\/strong>&nbsp;and a devastating blow to victims and their families.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This verdict confirms what LHRS has warned for years: \u201cthe Libyan justice system is unable, or unwilling, to prosecute powerful perpetrators of grave violations\u201d.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>The Case of Osama Elmasry Njeem: Shielding an ICC\u2011Wanted Torturer<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">On&nbsp;<strong>22 June 2026<\/strong>, the Office of the General Prosecutor announced a seven\u2011year sentence against&nbsp;<strong>Osama Elmasry Njeem<\/strong>, a senior security figure accused of torture, enforced disappearance, and other grave violations. Njeem is also&nbsp;<strong>wanted by the ICC<\/strong>&nbsp;for crimes against humanity and war crimes committed in Mitiga Prison since 2015.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Libyan prosecution:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>released\u00a0<strong>no details<\/strong>\u00a0about the charges,<\/li>\n\n\n\n<li>ignored the ICC\u2019s extensive case file,<\/li>\n\n\n\n<li>failed to address allegations of murder, rape, and systematic torture,<\/li>\n\n\n\n<li>and provided\u00a0<strong>no transparency<\/strong>\u00a0regarding the proceedings.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This opaque process raises serious concerns that the sentence is intended to&nbsp;<strong>shield Njeem from international accountability<\/strong>, not to deliver justice.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Torture Continues in Official and Parallel Institutions<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">LHRS continues to document:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>torture in prisons under the Ministry of Interior and Ministry of Justice,<\/li>\n\n\n\n<li>torture in facilities run by armed groups (including RADA, LAAF\u2011affiliated units, and western militias),<\/li>\n\n\n\n<li>enforced disappearances,<\/li>\n\n\n\n<li>sexual violence,<\/li>\n\n\n\n<li>deaths under torture,<\/li>\n\n\n\n<li>denial of medical care,<\/li>\n\n\n\n<li>and secret detention sites.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Victims and families face intimidation, retaliation, and silence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Impunity: The Central Driver of Torture in Libya<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The persistence of torture in Libya is rooted in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the failure of judicial authorities to prosecute perpetrators,<\/li>\n\n\n\n<li>the political protection granted to armed groups,<\/li>\n\n\n\n<li>the integration of militia leaders into state structures,<\/li>\n\n\n\n<li>and the deliberate obstruction of accountability mechanisms.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">When perpetrators are rewarded with official positions, budgets, and political cover, torture becomes not an aberration but a&nbsp;<strong>state\u2011enabled practice<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>LHRS Calls for Immediate Action<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>To the Libyan Authorities<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>End the use of torture in all detention facilities.<\/li>\n\n\n\n<li>Close all unofficial detention centers.<\/li>\n\n\n\n<li>Ensure independent investigations into all allegations.<\/li>\n\n\n\n<li>Hold commanders accountable under international humanitarian law.<\/li>\n\n\n\n<li>Cooperate fully with the ICC, including surrendering suspects.<\/li>\n\n\n\n<li>Allow UN bodies and human\u2011rights organizations full access to detention sites.<\/li>\n\n\n\n<li>Protect victims, witnesses, and human\u2011rights defenders.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>To the International Community<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Press Libya to uphold its obligations under the Convention Against Torture.<\/li>\n\n\n\n<li>Support independent monitoring of detention facilities.<\/li>\n\n\n\n<li>Ensure accountability for ICC\u2011wanted suspects.<\/li>\n\n\n\n<li>Condition security assistance on human\u2011rights compliance.<\/li>\n\n\n\n<li>Support Libyan civil society organizations documenting torture.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A Commitment to Victims<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On this day, LHRS honors the courage of survivors and the memory of those who died under torture.
